These Terms of Service ("Terms") apply to your use of cozycascade.com (the "Site") and any purchase you make from Cozy Cascade. The Site is operated by GEYER DIGITAL SUPPORT LLC, 9 Kingston Dr, Aurora, OH 44202 ("we", "us", "our"). By using the Site or placing an order, you agree to these Terms. If you do not agree, please do not use the Site.

1. Eligibility

You must be at least 18 years old, or the age of majority where you live, to place an order. We currently ship only to addresses in the contiguous United States.

2. Products and descriptions

We work to describe and photograph every product accurately, including dimensions and materials. Colors and finishes can look slightly different on different screens, and some images show products styled in a room with items that are not included. What is included is listed in each product description. If something you receive does not match its description, our Return and Refund Policy applies.

3. Prices and payment

All prices are in US dollars. Prices, products and discounts may change at any time before you place an order. We reserve the right to correct pricing or description errors and to cancel an order affected by such an error; if we do, we will refund you in full. Payment is processed securely at checkout by our payment providers; we do not store your full card details. Applicable sales tax is calculated at checkout.

4. Orders

Your order is an offer to buy. We accept it when we ship it. We may decline or cancel an order, for example if an item becomes unavailable or we suspect fraud, and we will refund any amount charged. If your order has not shipped yet, you can ask us to cancel it for a full refund.

5. Shipping

Items ship from US warehouses operated by our supplier partners. Shipping is free on orders to the contiguous US. Delivery estimates shown on the Site are estimates, not guarantees. Details are in our Shipping Policy.

6. Returns and refunds

Most items can be returned within 60 days of delivery with free return shipping. Damaged, defective or incorrect items are replaced or refunded. Full details are in our Return and Refund Policy, which forms part of these Terms.

7. Discounts and promotions

Discount codes and automatic discounts are subject to the conditions shown with them, have no cash value, and unless stated otherwise cannot be combined with other discounts. We may end a promotion at any time, but this will not affect an order you have already placed.

8. Product use and safety

Please follow the instructions and warnings that come with each product. Electrical products are intended for indoor use unless stated otherwise. Hardwired lighting should be installed by a qualified electrician where local code requires it.

9. Accounts and communications

You are responsible for the accuracy of the information you give us and for keeping any account login secure. If you sign up for emails, you agree to receive marketing messages from Cozy Cascade and affiliated stores operated by GEYER DIGITAL SUPPORT LLC. You can unsubscribe at any time using the link in any email.

10. Acceptable use

You agree not to misuse the Site, including by attempting to access it in unauthorized ways, interfering with its operation, scraping it in bulk, or using it for any unlawful purpose.

11. Intellectual property

The Site's content, including text, design, logos and original photography, belongs to us or our licensors and may not be copied or reused without our permission.

12. Reviews and content you submit

If you submit a review, photo or other content, you confirm it is your own honest experience and that you have the right to share it, and you allow us to display it on the Site and in our marketing. We do not edit reviews to change their meaning and we do not publish fake reviews.

13. Disclaimer

Except as stated in these Terms and our policies, and to the fullest extent permitted by law, the Site and products are provided "as is" and we disclaim implied warranties. Nothing in these Terms limits any rights you have under consumer-protection laws that cannot be waived, or any manufacturer warranty that comes with a product.

14. Limitation of liability

To the fullest extent permitted by law, we are not liable for indirect, incidental or consequential damages arising from your use of the Site or products, and our total liability for any claim relating to an order is limited to the amount you paid for that order. This does not limit liability that cannot be limited by law.

15. Governing law

These Terms are governed by the laws of the State of Ohio, without regard to its conflict-of-law rules. Any dispute will be handled in the state or federal courts located in Ohio, unless the law where you live gives you the right to bring it elsewhere.
